Pay and Benefit, Job Posting Requirements Maryland businesses must include wage ranges and benefit details in all job postings, including internal promotions and transfers. Wage ranges should be defined in good faith based on pay scales, budgets, or the wages of similar roles. Additionally, employers must disclose this information to applicants before discussing compensation. Ensure all job postings and internal processes are updated to reflect these new requirements. Equal Pay Law Expansion
Maryland's equal pay law protects employees based on sexual orientation, race, religious beliefs, and disability status. Previously, only gender was covered. Employers must now guarantee equal pay and opportunities across these newly included characteristics. Conduct a pay equity audit and review your compensation policies to address potential biases. Written Pay Information Requirements
Maryland is revising existing pay-related obligations, requiring employers to provide more detailed written notices at hiring and on pay stubs. This includes listing pay rates, gross and net pay, and hours worked. Ensure your payroll system complies with these new requirements by reviewing your pay stub formats and updating new hire documentation. MD H385
Military Status Protection Military status, including reservists and dependents of service members, is now protected under Maryland's anti-discrimination laws. Update your Equal Employment Opportunity (EEO) policies to reflect this change and train managers on how to ensure compliance. MD H598 The State of Maryland has created a Compensation Disclosure Form that employers can include in their job postings and provide to applicants. Using the state’s form is not mandatory.
